These Terms and Conditions ("Terms") govern your use of the website located at masonryberkeley.com (the "Site") operated by BMK Berkeley Masonry ("Company," "we," "us," or "our"), as well as any services, estimates, or work orders entered into between you and the Company. By accessing the Site or requesting services from us, you agree to be bound by these Terms.
If you do not agree to these Terms, please do not use the Site or engage our services.
You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to use the Site in any way that violates applicable federal, state, or local law or regulation, or in any manner that infringes on the rights of any third party.
You agree not to:
Estimates provided by BMK Berkeley Masonry are based on a visual assessment of conditions at the time of the estimate. Written estimates are valid for 30 days from the date of issuance unless otherwise noted. An estimate does not constitute a contract for services. Work will commence only after a written work order or contract has been signed by both parties.
Prices in an accepted work order may be subject to adjustment if unforeseen site conditions are discovered during the course of work that materially change the scope or cost of the project. We will notify you promptly and obtain your written approval before proceeding with any additional work.
All services are subject to the payment terms, warranty terms, and project-specific conditions set forth in the applicable written work order or contract. In the event of a conflict between these Terms and a signed work order, the terms of the signed work order shall control.
All content on the Site, including but not limited to text, photographs, graphics, logos, and the selection and arrangement thereof, is owned by BMK Berkeley Masonry or its licensors and is protected by applicable intellectual property law. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent.
The Site is provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
Information on the Site is provided for general informational purposes only and does not constitute professional engineering, structural, or legal advice. You should consult a licensed professional before making decisions based on information found on this Site.
To the maximum extent permitted by applicable law, BMK Berkeley Masonry, its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Site, or from services provided by us, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or relating to these Terms or your use of the Site shall not exceed one hundred U.S. dollars ($100.00). Liability for physical property damage or personal injury arising from services performed under a signed work order is governed by that work order and our insurance coverage.
You agree to defend, indemnify, and hold harmless BMK Berkeley Masonry and its officers, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site.
