1. Agreement to Terms

By accessing or using the services provided by BMK Berkeley Masonry, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services or website. We reserve the right to modify these terms at any time, and your continued use of our services after changes are posted constitutes acceptance of those changes.

2. Services Provided

BMK Berkeley Masonry provides professional masonry services including but not limited to brick repair, chimney work, tuckpointing, retaining walls, stone patios, and related construction services. All services are provided subject to availability and our acceptance of your project. We reserve the right to refuse service to anyone for any lawful reason.

3. Estimates and Pricing

All estimates provided are valid for 30 days from the date of issue unless otherwise specified. Estimates are based on the information available at the time and may be subject to change if project scope changes or unforeseen conditions are discovered. Final pricing will be confirmed in writing before work begins. Payment terms will be specified in your service agreement.

4. Project Changes and Additional Work

If during the course of a project we discover additional work is needed or you request changes to the original scope, we will provide a written change order detailing the additional costs and timeline impact. No additional work will begin without your written approval. You agree to pay for all approved additional work according to the terms specified in the change order.

5. Customer Responsibilities

You agree to provide safe and reasonable access to the work area and to remove or protect any personal property that may be affected by the work. You are responsible for obtaining any necessary permissions from homeowners associations or other governing bodies. You must also ensure that pets are secured and that someone authorized to make decisions is available during the project.

6. Warranty and Guarantees

We stand behind our work and provide warranties as specified in your service agreement. Warranty coverage varies by service type and will be clearly stated in your contract. Warranties do not cover damage caused by acts of nature, accidents, misuse, or lack of proper maintenance. To maintain warranty coverage, you must follow any maintenance instructions provided.

7. Limitation of Liability

BMK Berkeley Masonry maintains appropriate insurance coverage for all work performed. Our liability is limited to the cost of correcting defective work or, at our option, refunding the amount paid for the defective portion of the work. We are not liable for any indirect, incidental, or consequential damages arising from our services. Some jurisdictions do not allow limitations on implied warranties, so some of these limitations may not apply to you.

8. Cancellation and Refunds

If you need to cancel a scheduled project, please notify us as soon as possible. Cancellations made less than 48 hours before the scheduled start date may be subject to a cancellation fee to cover administrative costs and lost scheduling opportunities. Refunds for deposits or prepayments will be handled according to the terms specified in your service agreement.

9. Dispute Resolution

If a dispute arises regarding our services, we encourage you to contact us directly so we can work together to resolve the issue. If we cannot reach a resolution, you agree to participate in good-faith mediation before pursuing any legal action. Any legal disputes will be governed by the laws of the State of California and resolved in the courts of Alameda County.
